The New York Times story didn't mention anything about a pending lawsuit, only that during his time in the hospital Mr. Quinn had thought about hiring a lawyer. Both the makers of the artificial heart and the surgeon involved were very open and forthcoming in the story. Usually when a lawsuit is pending, no one says anything. Were they set up, or did the lawyers read the story and chase down a client?
